Pedestrian Injury Cases
During the past several years my office has helped several people who were injured while walking or crossing the street. When a pedestrian is hit by a car serious injuries or death can result, even at low or moderate speeds. Pedestrian injury cases are unique in two main respects. The first is that there is a unique statutory duty of good faith owed by the driver of the vehicle. The second is that while in a significant number of these cases some responsibility for the accident may actually rest with the pedestrian, under South Carolina law this is not a bar to recovery.
